Please read these Terms and Conditions (“Terms”) carefully before using the services offered by LevelUp eSports Cafe  (“we”, “us”, “our”) via our website https://levelupesportscafe.com or at our physical cafe location in Navi Mumbai, Maharashtra.

By accessing or using any of our services, you agree to be legally bound by these Terms, in accordance with Indian laws, including the Information Technology Act, 2000, Digital Personal Data Protection Act, 2023, and the Consumer Protection Act, 2019.


1. Definitions

  • Company: Refers to LevelUp eSports Café, located at Dharmjivan Society, 104, Plot No. 86, Above ICICI Bank, Sector 6, Kopar Khairane, Navi Mumbai, Maharashtra – 400709.
  • Website: Refers to https://levelupesportscafe.com.
  • Service: Refers to any services offered by the Company including gaming slot bookings, events, tournaments, internet use, and related facilities.
  • User / You: Refers to any individual or entity using or accessing our Service.
  • Device: Any device (mobile, computer, tablet) used to access the Service.
  • Payment Gateway: Refers to Razorpay, our integrated and RBI-compliant payment service provider.
  • Affiliate: Any entity directly or indirectly controlled by or under common control with the Company.

2. Acceptance of Terms

By using our Website or booking services online or offline, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.


3. Eligibility

You must be at least 18 years old to use or register for our services. By using the Service, you represent and warrant that you meet the eligibility criteria under Indian law.


4. Booking and Payments

  • All gaming sessions or event slots must be pre-booked via our website or at the café.
  • Payments are processed through Razorpay, a secure and RBI-authorized payment gateway.
  • We do not store your card or banking information.
  • Bookings are subject to availability and confirmed only upon successful payment.
  • All bookings are non-transferable and may be subject to cancellation or rescheduling based on café availability.

5. Refund and Cancellation

  • No refunds will be processed once a session or service is booked, except in cases of double billing or payment error.
  • Rescheduling of bookings may be allowed if requested at least 4 hours before the slot time, subject to availability.
  • Any refund request will be reviewed and processed in accordance with the Consumer Protection (E-Commerce) Rules, 2020 and applicable Razorpay refund policies.

6. Code of Conduct

Users must:

  • Respect other gamers and café staff.
  • Avoid any abusive, threatening, or harassing behavior.
  • Not engage in cheating, hacking, or illegal activities.
  • Not damage café property, systems, or hardware.

We reserve the right to terminate access immediately for violation of the above, without refund.


7. Third-party Services

Our Website may contain links to or integrations with third-party services such as Razorpay, social platforms, etc. We are not responsible for the privacy practices, data collection, or terms of such external services.


8. Limitation of Liability

To the maximum extent permitted by Indian law:

  • The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or business opportunities, arising from the use of our services.
  • Our total liability is limited to the actual amount paid by you for a service or a maximum of ₹8,000 INR, whichever is lower.

9. “As Is” Disclaimer

All services are provided on an “as-is” and “as-available” basis. We make no guarantees of uninterrupted access, error-free experience, or compatibility with your personal devices.


10. Data Protection

We collect, store, and process your personal data in compliance with the Digital Personal Data Protection Act, 2023 and other applicable data privacy laws. For more, please read our Privacy Policy.


11. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India, specifically under the jurisdiction of courts in Navi Mumbai, Maharashtra.


12. Dispute Resolution

If you have any concerns or disputes related to our service, you agree to first attempt to resolve the matter informally by contacting us.

In case of unresolved disputes, the matter shall be referred to a sole arbitrator, appointed mutually, in accordance with the Arbitration and Conciliation Act, 1996. Arbitration will be held in Mumbai, and proceedings shall be conducted in English.


13. Modifications

We reserve the right to amend or modify these Terms at any time. Changes will be posted on this page with the updated date. Continued use of our services after such changes implies acceptance of the revised Terms.
